1. What is André

André is a mobile application that helps you organise your GLP-1 treatment: it records doses, injection sites, weight, symptoms and reminders.

André is NOT a medical product or a medical device under Regulation (EU) 2017/745 (MDR). It does not diagnose, prescribe, recommend doses or replace the judgment of your doctor, pharmacist or the instructions for your medication. It is a personal organisation tool.

3. Acceptance

By downloading, installing or using André, you accept these Terms of Service. If you do not agree with any of them, do not use the app.

4. Who may use it

André is intended for persons aged 18 or over who are on a GLP-1 treatment prescribed by a healthcare professional. By using the app you represent that you meet this age requirement.

5. Your responsibility

• Record accurate data and correct any errors (you can edit or delete doses and weight entries from within the app).
• Do not use André to decide dose changes or medication changes on your own. Any change to your treatment must be directed by your healthcare professional.
• Keep your mobile device secure: anyone who opens it can see your records, as the app has no account system or built-in lock.
• Export your data before uninstalling the app if you wish to keep it.

6. Medical disclaimer

André records the information you enter. It does not verify whether a dose is correct, does not detect drug interactions, does not interpret symptoms and does not provide medical advice of any kind.

The informational content on the website and in the app (medication descriptions, side effects, injection sites) is for general educational purposes only and does not constitute medical advice. Always consult your healthcare professional before making decisions about your treatment.

7. Intellectual property

The André app, its code, design, logo, text and content are the property of André or are used under licence. You may not copy, modify, distribute or create derivative works without express authorisation.

The trade names of medications mentioned (Mounjaro, Ozempic, Wegovy, Zepbound, Saxenda) are registered trademarks of their respective owners. André has no commercial relationship with Eli Lilly, Novo Nordisk or any other pharmaceutical company.

8. Business model: advertising and subscription

André operates on a freemium model:

• Free version: all app features are available. Ads are displayed through Google AdMob.
• Subscription (André Pro): removes all ads. Payment is processed through the Apple App Store or Google Play Store.

8.1 Subscription terms

• The subscription renews automatically at the end of each period (monthly or annual, depending on the plan chosen), unless you cancel it.
• You may cancel the automatic renewal at any time from your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of the current paid period: you will continue to enjoy the subscription until that date.
• Refunds are governed by the policies of Apple or Google, depending on the platform where you purchased the subscription.
• André does not process payments directly: every transaction goes through the corresponding app store.

8.2 Plan changes

If you cancel your subscription, once the paid period expires you will automatically return to the free version with ads. You will not lose any data: all your treatment information remains intact on your device.

9. Availability and changes

We reserve the right to:

• Modify subscription prices, with prior notice through the app store.
• Modify, suspend or discontinue the app, in whole or in part, with reasonable notice when possible.
• Update these terms. The current version will always be the one published at andre-app.com/en/terms with its update date. Material changes will be notified within the app.

10. Limitation of liability

André is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by applicable law:

• We do not guarantee that the app will be free from errors, interruptions or technical failures.
• We are not liable for medical decisions made based on information recorded in the app.
• We are not liable for data loss if you uninstall the app without having exported your data.
• Our total liability to you, for any cause, is limited to the amount you have paid for the subscription in the 12 months preceding the event giving rise to the claim.

Nothing in these terms excludes or limits our liability for fraud, gross negligence or any situation in which the law does not permit exclusion.

11. Indemnification

You agree to hold André harmless from any claims, damages or expenses arising from your use of the app in breach of these terms or applicable law.

12. Distribution platforms (App Store and Google Play)

If you downloaded André from the Apple App Store or Google Play Store:

• These terms are an agreement between you and André, not with Apple Inc. or Google LLC.
• Apple and Google have no obligation to provide maintenance or support services for the app.
• If the app fails to conform to an applicable warranty, Apple may refund the purchase price (if any). Apple and Google have no further liability for the app.
• Apple and Google, and their subsidiaries, are third-party beneficiaries of these terms and may enforce them against you.
• By using the app, you represent that you are not located in a country subject to a U.S. Government embargo or on any list of prohibited parties.

13. Governing law and jurisdiction

These terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the courts of the city where the owner is domiciled, without prejudice to the rights you may have as a consumer under the consumer-protection regulations of your habitual place of residence.

14. Severability

If any clause of these terms is declared void or unenforceable, the remainder shall continue in force. The affected clause shall be interpreted in the manner closest to its original intent.

15. Entire agreement

These terms, together with the Privacy Policy, constitute the entire agreement between you and André regarding the use of the app and the website, and supersede any prior agreement or communication.
